The Fourth Court of Appeals ruled in favor of VIA Metropolitan Transit who appealed the denial of its Plea to the Jurisdiction in a personal injury case brought by a VIA passenger who fell while using a bus access ramp.  The court of appeals reversed the decision of the trial court and rendered judgment dismissing all of the plaintiff’s claims against VIA.  The appellate court concluded the plaintiff’s claims against VIA did not arise from the operation or use of the bus as required to waive governmental immunity under the Texas Tort Claims Act.  David Montpas represented VIA in the appeal.
