Prichard Young helped defeat the latest efforts by an attorney to avoid repaying his former client, a south Texas rancher. The Fifth Circuit had previously affirmed a multi-million dollar judgment against the attorney. See Prichard Young Wins Appeal in the Fifth Circuit, Nov. 22, 2022.

ln this latest appeal, the attorney argued his filing for bankruptcy absolved him from having to pay a part of the judgment, valued at over $3.7 million, because the arbitrator’s award had no preclusive effect on the bankruptcy court. The bankruptcy court and the district court previously rejected this argument, and the Fifth Circuit agreed. David Prichard and David Montpas, along with David Gragg and Natalie Wilson of Langley & Banack in San Antonio, represented the rancher in the bankruptcy court, district
court, and court of appeals. Scott Lawrence of Wick Phillips Gould & Martin in Dallas represented the attorney.
