David Montpas successfully argued to a panel of the Fifth Circuit Court of Appeals in New Orleans that it should affirm a summary judgment on behalf of Honda in a wrongful death case. The plaintiff alleged a defect in the algorithm used for airbag deployment, among other things. At the district court, Prichard Young successfully argued there was no evidence of a safer alternative design, which is a mandatory requirement of Texas product liability law. On appeal, the plaintiff challenged several of the district court’s evidentiary and procedural rulings, but David persuaded the Fifth Circuit to affirm the summary judgment in favor of Honda.
